28 Undertakings to appear
(1) A person may be released on bail only if the person gives a written undertaking—
(a) to appear before a stated court at the place, date and time—
(i) stated in the undertaking; or
(ii) notified to the person by a police officer; and
(b) to comply with the bail conditions (if any).
Note If a form is approved under s 58 for an undertaking, the form must be used.
(2) For a continuation of bail, the person may undertake to appear at any time when, and at any place where, proceedings in relation to the offence with which the person has been charged may be continued.
(3) An undertaking may be given in relation to more than 1 offence.
(4) A court must accept an undertaking given under this section as proof of the matters stated in it if there is no evidence to the contrary.
(5) Subsection (1) (a) does not apply to a person in relation to a breach of the peace or apprehended breach of the peace if no further appearance is required.
