Australian Capital Territory Numbered Acts Australian Capital Territory Numbered Acts(1) This section applies if, in relation to a hearing for an inquiry, or part of the hearing, the presiding officer has given a direction under either of the following sections of the Evidence (Miscellaneous Provisions) Act 1991 :
(a) section 20 (Territory courts may take evidence and submissions from outside ACT);
(b) section 32 (Use of link in proceedings).
(2) A person may appear and take part in the hearing in accordance with the direction, if the person—
(a) is required or entitled to appear personally, whether as the accused or as a witness; or
(b) is entitled to appear for someone else.
(3) A person who appears
at the hearing under this section is taken to be before the presiding officer.
