93. (1) Where the Commissioner dismisses a complaint which the Commissioner believes on reasonable grounds is vexatious or frivolous or was not made in good faith, the Commissioner may, by notice in writing given to the complainant, direct the complainant to pay to a respondent a specified amount—
(a) authorised by the Commissioner in accordance with the prescribed scale; or
(b) if there is no prescribed scale—determined by the Commissioner;
in respect of the expenses reasonably incurred by the respondent in relation to the investigation of the complaint.
(2) The amount specified in a direction is a debt due by the complainant to the respondent.
