INTOXICATED PERSONS (CONSEQUENTIAL (NO. 86 OF 1994) - SECT 3

Coroners Act 1956

3. Section 2 of the Coroners Act 1956 is amended—

    (a)     by omitting from paragraph (e) of the definition of “custodial officer” in subsection (1) “or” (last occurring);

    (b)     by adding at the end of paragraph (f) of the definition of “custodial officer” in subsection (1) “or”;

    (c)     by adding at the end of the definition of “custodial officer” in subsection (1) the following paragraph:

    “(g)     a carer within the meaning of the Intoxicated Persons (Care and Protection) Act 1994 ;”;

    (d)     by omitting from paragraph (2) (d) “or” (last occurring);

    (e)     by adding at the end of paragraph (2) (e) “(other than a custodial officer referred to in paragraph (g) of the definition of ‘custodial officer' in subsection (1)); or”;

    (f)     by inserting after paragraph (2) (e) the following paragraph:

    “(f)     while at a licensed place within the meaning of the Intoxicated Persons (Care and Protection) Act 1994 ;”;

and

    (g)     by omitting from subsection (2) “(e)” (last occurring) and substituting “(f)”.
