(1) A person commits an offence if—
(a) the person obtains a declared substance that is—
(i) a pharmacy medicine, or pharmacist only medicine, prescribed by regulation; or
(ii) a prescription only medicine; or
(iii) a controlled medicine; or
(iv) a dangerous poison; or
(v) a prohibited substance; and
(b) the person is not authorised to obtain the substance.
Maximum penalty: 200 penalty units, imprisonment for 2 years or both.
(2) A person commits an offence if—
(a) the person obtains a prescription only medicine; and
(b) the person is not authorised to obtain the medicine.
Maximum penalty: 50 penalty units.
(3) An offence against subsection (2) is a strict liability offence.
