(1) The director-general may apply to the Supreme Court for an order appointing a stated person as an administrator in relation to the operator of a retirement village—
(a) to exercise all the functions of the operator; or
(b) to exercise stated functions of the operator; or
(c) to exercise all the functions other than stated functions of the operator.
(2) The director-general may apply for an order only if—
(a) the director-general reasonably believes that the well-being or financial security of the residents of the village has been, or is likely to be, seriously affected by the continued operation of the village by the operator; or
(b) the director-general reasonably believes that the operator is wilfully and repeatedly acting in contravention of an order made by the ACAT or a court in relation to the village; or
(c) the village is the subject of an existing order under this section.
(3) For the purpose of determining whether an application for an order should be made, the director-general may appoint a person to inquire into, and report to the director-general on, the well-being and financial security of the residents of the village.
(4) More than 1 order may be made under this division in relation to the same village.
