RETIREMENT VILLAGES ACT 2012 (NO. 38 OF 2012) - SECT 90

Operator to provide secure premises

    (1)     The operator of a retirement village must ensure that the village generally is reasonably secure.

    (2)     Without limiting subsection (1), the operator must ensure that all residential premises in the village—

        (a)     have enough locks or other security devices necessary to make the premises reasonably secure; and

        (b)     that the locks and other security devices are in good working order.

    (3)     Subsection (2) does not apply in relation to residential premises that are subject to a community title scheme, company title scheme or units plan unless the operator, or a close associate of the operator, is the owner of the premises.

    (4)     A resident of a retirement village who believes on reasonable grounds that the village is not reasonably secure may apply to the ACAT for the following:

        (a)     an order directing the operator to comply with subsection (1) or (2);

        (b)     any other order mentioned in section 181 (1) (ACAT orders).
