WATER EFFICIENCY LABELLING AND STANDARDS ACT 2005 (NO. 10 OF 2005) - SECT 34

Labelling registered products

    (1)     A person commits an offence if—

        (a)     the person supplies a WELS product; and

        (b)     the product is registered; and

        (c)     the applicable WELS standard requires registered products to be WELS-labelled for the purposes of the supply; and

        (d)     the product is not WELS-labelled.

Maximum penalty: 60 penalty units.

    (2)     An offence against this section is a strict liability offence.
