Defences for not giving a comparison
1
(4A) For the purposes of paragraphs (1)(ba) and (bb), and of
2
subsection (2) so far as it relates to either of those paragraphs, it is
3
a defence if the licensee reasonably believes that:
4
(a) another person has:
5
(i) shown the consumer in person the comparison described
6
in paragraph (1)(ba); and
7
(ii) given the consumer a printed copy of the comparison;
8
and
9
(b) the comparison is the same, or substantially the same, as the
10
comparison paragraph (1)(ba) requires the licensee to show
11
the consumer.

Note:
For the purposes of subsection (2), a defendant bears an evidential
13
burden in relation to the matter in subsection (4A) (see
14
subsection 13.3(3) of the
Criminal Code
).

(4B) For the purposes of paragraphs (1)(ba) and (bb), and of
16
subsection (2) so far as it relates to either of those paragraphs, it is
17
a defence if the circumstances prescribed by the regulations exist.

) if the circumstances referred to in

subsection (2) or (3) exist.

Note:
Sections 178 and 179 provide for remedies for anyone who suffers, or
7
is likely to suffer, loss or damage because of a breach of this section.
8
For example, if a licensee makes a credit contract for a reverse
9
mortgage with a consumer when the circumstances referred to in
10
subsection (2) or (3) of this section exist, a person who suffers, or is
11
likely to suffer, loss as a result may be able to get court orders under
12
section 178 or 179 to put the person in a position like the one the
13
person would have been in had the circumstances not existed.

Civil penalty:
5,000 penalty units.

Youngest debtor is aged under 56 years
16
(2) The circumstances are that, on the credit day:
17
(a) the youngest person who is, or would be, a debtor under the
18
credit contract is aged under 56 years; and
19
(b) the loan to value ratio of the mortgage worked out under
20
subsection (5) exceeds 15%.

Youngest debtor is aged 56 years or older
22
(3) The circumstances are that, on the credit day:
23
(a) the youngest person who is, or would be, a debtor under the
24
credit contract is aged 56 years or older; and
25
(b) the loan to value ratio of the mortgage worked out under
26
subsection (5) exceeds the sum of:
27
(i) 16%; and
28
(ii) 1% for each year (if any) that the person is aged more
29
than 56 years.

Exception for special circumstances

(4) Subsection (1) does not apply if the licensee reasonably believed
32
that the credit contract, or the increase to the credit limit of the
33
credit contract, was appropriate because of special circumstances
34
of the consumer.

Loan to value ratio
1
(5) For the purposes of paragraphs (2)(b) and (3)(b), the loan to value
2
ratio of a reverse mortgage is the amount of credit owed, or
3
intended to be owed, under the credit contract for the reverse
4
mortgage, expressed as a percentage of the value of the dwelling or
5
land that is, or may become, reverse mortgaged property.

This Part has rules that apply to licensees in relation to credit

credit provider is not an ADI.

The Part provides that the Minister may make standards specifying
17
requirements for systems, policies and processes a licensee must
18
establish and maintain.

(1) The Minister may, by legislative instrument, determine non-ADI
24
credit standards that specify requirements with which a licensee's

systems, policies and processes relating to non-ADI credit conduct
1
must comply.

(2) The non-ADI credit standards may require a licensee to give a
3
consumer a copy of a document at a time, and in a manner,
4
specified in the standard.
5
(3) The non-ADI credit standards may be of general application or
6
may be limited as provided in the determination.
7
(4) Without limiting subsection 33(3A) of the
Acts Interpretation Act
8

, the non-ADI credit standards may make different provision
9
in relation to:
10
(a) different situations; or
11
(b) different activities; or
12
(c) different classes of licensees; or
13
(d) different classes of credit providers.

Non-ADI credit conduct
15
(5)
Non-ADI credit conduct
is conduct that consists of a licensee:
16
(a) entering a credit contract covered by subsection (6) with a
17
consumer who will be the debtor under the contract; or
18
(b) making an unconditional representation to a consumer that
19
the licensee considers that the consumer is eligible to enter a
20
credit contract covered by subsection (6) with the licensee; or
21
(c) increasing the credit limit of a credit contract covered by
22
subsection (6) with a consumer who is the debtor under the
23
contract; or
24
(d) making an unconditional representation to a consumer that
25
the licensee considers that the credit limit of a credit contract
26
covered by subsection (6) between the consumer and the
27
licensee will be able to be increased.

Non-ADI credit contracts
29
(6) This subsection covers a credit contract if:
30
(a) the contract is not a small amount credit contract; and
31
(b) the credit provider under the contract is not an ADI.

133EB Licensee must establish and maintain systems, policies and
1
processes
2
(1) A licensee must not engage in non-ADI credit conduct if:
3
(a) the non-ADI credit standards specify requirements relating to
4
systems, policies and processes relating to that conduct; and
5
(b) either:
6
(i) the licensee has not established, or does not maintain,
7
systems, policies and processes that comply with those
8
requirements; or
9
(ii) the licensee does not have a written plan that documents
10
the systems, policies and processes the licensee has
11
established, and maintains, that comply with those
12
requirements.
13
Civil penalty:
5,000 penalty units.
14
(2) A licensee must retain a plan described in subparagraph (1)(b)(ii)
15
for 7 years after the end of the period to which the plan relates.
16
Civil penalty:
5,000 penalty units.
17
133EC Licensee must comply with requirements of its systems,
18
policies and processes
19
(1) A licensee must not engage in non-ADI credit conduct if:
20
(a) the non-ADI credit standards specify requirements relating to
21
systems, policies and processes relating to the non-ADI credit
22
conduct; and
23
(b) the licensee has established systems, policies and processes
24
for the purpose or purported purpose of complying with those
25
requirements; and
26
(c) those systems, policies and processes require the licensee to
27
engage in conduct (the
required conduct
) before the licensee
28
engages in the non-ADI credit conduct; and
29
(d) the licensee has not engaged in the required conduct.
30
(2) A licensee must not repeatedly contravene subsection (1).

Civil penalty:
5,000 penalty units.

(3) The obligation a licensee has to comply with subsection (1) is
1
taken for the purposes of the following provisions not to be an
2
obligation under the credit legislation:
3
(a) paragraph 37(1)(b) (when a licence may be granted);
4
(b) paragraph 47(1)(d) (general conduct obligations for
5
licensees);
6
(c) paragraph 55(1)(a) (when a licence can be suspended or
7
cancelled);
8
(d) paragraphs 80(1)(d) and (e) (when ASIC may make a
9
banning order).
10
(4) To avoid doubt, subsection (3) does not affect the operation of the
11
provisions referred to in that subsection in relation to the obligation
12
that arises under subsection (2).

133ED Giving a consumer a document
14
(1) If the non-ADI credit standards require a licensee to give a
15
consumer a copy of a document at a time, the licensee must give
16
the consumer a copy of the document at that time.
17
Civil penalty:
5,000 penalty units.
18
(2) The licensee must give the consumer a copy of the document in the
19
manner (if any) specified in the standards.

the contravention. The amount of compensation is not to exceed
6
the amount of the loss.

(3) The court may not make an order under this section if the debtor,

lessee or guarantor has previously obtained or been refused a

penalty referred to in section 115 relating to the same

contravention.

(4) An amount payable under this section does not affect the amount

(1) Regard must be had to the following matters in determining for the

purposes of section 323A whether it would be reasonable to

conclude that a purpose of a person (the
first person
) entering into

or carrying out (to any extent) a scheme was an avoidance purpose
18
relating to a contract:
19
(a) whether the scheme or the contract was, is or would be:
20
(i) a means of providing a consumer with credit in a
21
manner more complex, or more costly to the consumer,
22
than a small amount credit contract would have been; or
23
(ii) a means of providing a consumer with financial
24
accommodation equivalent to providing the consumer
25
with credit in a manner more complex, or more costly to
26
the consumer, than a small amount credit contract
27
would have been; or
28
(iii) a means of enabling a consumer to have the use of
29
goods in a manner more complex, or more costly to the
30
consumer, than a consumer lease would have been;
31
(b) whether representations were made (by the first person or
32
anyone else, and whether in an advertisement or otherwise)

(ii) were made to persons in a group similar to a group of
7
persons to whom representations about small amount
8
credit contracts or consumer leases were made (by the
9
first person or anyone else, and whether in an
10
advertisement or otherwise);
11
(c) a matter prescribed by the regulations.

(2) Subsection (1) does not limit the matters to which regard may be
13
had in making a determination described in that subsection.

323C Presumption of avoidance for certain schemes in civil cases
15
(1) For the purposes of subsection 323A(1), (3), (4) or (5), it is
16
reasonable to conclude that a person entered into or carried out a
17
scheme for an avoidance purpose if:
18
(a) the scheme is of a kind prescribed by the regulations; or
19
(b) the scheme is of a kind determined by ASIC under
20
subsection (3).
21
(2) A conclusion that this section provides for has effect except so far
22
as the contrary is proved by the person, having regard to the
23
matters referred to in subsection 323B(1).
24
(3) ASIC may, by legislative instrument, determine a scheme, or a
25
class of schemes, for the purposes of this section.
26
(4) This section does not have effect for the purposes of
27
subsection 323A(7).

323D Exemption by ASIC

(1) ASIC may, by legislative instrument, exempt a scheme, or class of
30
schemes, from all or specified provisions of section 323A.
