A Bill for an Act to close the Student Financial
Supplement Scheme to applications from 1 January 2004, and for other
purposes
The Parliament of Australia enacts:
This Act may be cited as the Student Assistance Amendment Act
2003.
This Act commences on the day on which it receives the Royal
Assent.
Each Act that is specified in a Schedule to this Act is amended or
repealed as set out in the applicable items in the Schedule concerned, and any
other item in a Schedule to this Act has effect according to its
terms.
1 Subsection 3(1) (at the end of the definition of
eligible student)
Add:
Note: A person is not an eligible student for the whole or
part of a year that begins on or after 1 January 2004 (see
section 12AA).
2 Subsection 3(1) (at the end of the definition of
Student Financial Supplement Scheme)
Add:
Note: The Student Financial Supplement Scheme is closed to
applications from 1 January 2004 (see Division 1A of
Part 4A).
3 Before Division 1 of
Part 4A
Insert:
The object of this Division is to close the Student Financial Supplement
Scheme to applications from 1 January 2004.
For the purpose of this Part, a person is not an eligible student in
relation to a year that begins on or after 1 January 2004, or part of such
a year.

12C(1)
Add:
Note: A person is not an eligible student for the whole or
part of a year that begins on or after 1 January 2004 (see
section 12AA).
5 After subsection 12F(1)
Insert:
(1A) Subsection (1) does not apply in relation to a year or part of a
year if the year begins on or after 1 January 2004.

After “notice”, insert “under
subsection (1)”.

Omit “section 48”, substitute “subsection
48(1)”.

Omit “section 48”, substitute “subsection

Add:
(2) In spite of section 49A of the Acts Interpretation Act
1901, regulations for the purposes of subsection (1) relating to
notifying the Department may apply, adopt or incorporate any matter contained in
any instrument or other writing as in force or existing from time to
time.
