without permitting any person other than a member of the Tribunal as constituted for the
purposes of the proceeding or a member of the staff of the Tribunal in the course of the
performance of his or her duties as a member of that staff, to have access to the document
or disclosing the contents of the document to any such person.

73AG After paragraph 66(2)
Insert:
(2A) Where a person makes application to the Tribunal under section 55 for a review of a
decision relating to access to a document and after the application is made:
(a) the agency or Minister issues a certificate in relation to the document; or
(b) the agency or Minister claims a new ground for refusing to grant access to the
document and the Tribunal is not satisfied that the document is an exempt document
on the ground or grounds claimed by the agency or Minister in refusing to grant
access to the document;
the Tribunal may, in its discretion, recommend to the Attorney-General that the costs of
the applicant in relation to the proceedings be paid by the Commonwealth.
