1991 No. 329 EXPLOSIVES REGULATIONS - REG 32

Repairs etc.
32. (1) Upon receiving a report under regulation 31, the supervisor of the
transportation must investigate the matters to which the report relates and,
where it appears to the supervisor that action is required to be taken in
respect of the explosives or vehicle before the transportation may be resumed
safely, the supervisor must:

   (a)  if the action can be taken at the place where the vehicle is stopped
        without undue delay and without endangering the safety of the public,
        arrange for the action to be so taken; or

   (b)  in any other case, ensure that:

        (i)    the vehicle is moved, as soon as practicable, to the safest
               practicable location;

        (ii)   persons in the vicinity are warned of the hazard to them; and

        (iii)  a member of the local police force is informed of the required
               action; and

        (iv)   the consignor or consignee of the goods is informed of the
               required action; and

        (v)    so far as possible, having regard to the safety of the public,
               the vehicle and explosives are dealt with in accordance with
               the instructions (if any) of the consignor or consignee, as the
               case may be.

(2) If a road vehicle being used to transport Commonwealth explosives is
stopped in accordance with regulation 29 or 30 and a defect in, or damage to,
the vehicle is detected and reported to the supervisor of the transportation,
the supervisor must not permit the transportation of those Commonwealth
explosives by that vehicle to be resumed unless it safe to do so.
