1991 No. 329 EXPLOSIVES REGULATIONS - REG 41
Poor visibility
41. (1) Except when directed to do so by the supervisor of the transportation,
the driver of a road vehicle being used to transport Commonwealth explosives
must not drive the vehicle on a road at a time when:
(a) if a person were at a distance of 50 metres directly in front of the
vehicle; or
(b) if another vehicle were at a distance of 100 metres directly in front
of the vehicle; that person or that other vehicle would, because of
the poor visibility prevailing at that time, not be visible with the
assistance of any appropriate artificial illumination available to
that driver.
(2) If it appears to the supervisor of the transportation of Commonwealth
explosives by road to be necessary, in interests of public safety or security,
that a road vehicle being used to transport the explosives be driven at a time
referred to in subregulation (1), the supervisor may direct the driver to
drive the vehicle at that time, subject to such restrictions (if any) as the
supervisor considers necessary in the circumstances.
