SUMMARY AUTHORITY RULES (SLI NO 196 OF 2008) - RULE 81

Definitions for Part 14

                In this Part:

"original summary authority" means the person who concluded the summary authority proceedings that are to be reopened in accordance with a request from a reviewing authority.

relevant proceedings mean the summary authority proceedings that:

                (a)    resulted in the conviction of a person for a service offence; and

               (b)    are the subject of a request in accordance with section 153 of the Act.

reviewing authority means:

                (a)    for subordinate summary authority proceedings -- a commanding officer who is reviewing the proceedings; and

               (b)    for commanding officer proceedings or superior summary authority proceedings -- a competent reviewing authority who is reviewing the proceedings.
