(1) The Minister, by published notice, may (a) determine any specified areas of State waters to be open to the commercial scallop fishery; and(b) determine any specified areas of State waters to be open to the commercial scallop fishery for a method of fishing; and(c) specify the amount of scallops that may be taken from, or possessed in, an area determined to be open under paragraph (a) or (b) .(2) All areas of State waters that are not determined to be open under subrule (1)(a) are closed to the commercial scallop fishery.(3) An area of State waters that is determined to be open for a method of fishing under subrule (1)(b) is closed to the commercial scallop fishery for all methods of fishing other than the method to which the determination relates.(4) The Minister, by published notice, may determine any specified areas of State waters to be scallop vessel exclusion zones.
