ROAD RULES 2019 - REG 297

Driver to have proper control of a vehicle, &c.
(1)  A driver must not drive a vehicle unless the driver has proper control of the vehicle.
Penalty:  Fine not exceeding 10 penalty units.
(1A)  A person must not drive a vehicle if a person or an animal is in the driver’s lap.
Penalty:  Fine not exceeding 10 penalty units.
(2)  A driver must not drive a motor vehicle unless the driver has a clear view of the road, and traffic, ahead, behind and to each side of the driver.
Penalty:  Fine not exceeding 10 penalty units.

Note Motor vehicle is defined in the dictionary.

(3)  The rider of a motor bike, or quad bike, must not ride with an animal on the bike between the rider and the handlebars, or in another position that interferes with the rider’s ability to control the bike or to have a clear view of the road.
Penalty:  Fine not exceeding 10 penalty units.

Note 1 Motor bike and quad bike are defined in the dictionary.

Note 2 Subrules (3) and (4) have been amended to include quad bikes and are no longer uniform with the model road rules of Australia.

(4)  Subrule (3) does not apply to the rider of a motor bike, or quad bike, who rides with an animal between the rider and the handle bars for a distance of not more than 500 metres on a road for the purpose of a farming activity that the rider is carrying out.
